Terms and conditions

The competition is open to open to all software developers, including individuals, companies and open source communities other than employees of BT, its agencies or their families and employees of Symbian, its agencies or their families.

2. The prizes are one first prize of the sum of one thousand pounds (£1000), two second prizes of the sum of two hundred and fifty pounds (£250) and ten third prizes of a Symbian Press book of the winner’s choice. If the winning entry has been entered by a group of individuals then the prize shall be divided among them as they choose. If the winning entry has been entered by a company or other organisation, then the prize shall be paid to that company or organisation.

3. The third prize is subject to availability.

4. The Promoter reserves the right to substitute a prize of equivalent or greater value if this is necessary for reasons beyond its control.

5. Entries to the competition must be applications created for Wi-Fi-enabled Symbian OS-based devices. Entries must utilise the Wi-Fi connection of the device for some of their operation (though they may also operate over the GPRS/3G connection or in an offline mode). Entries should be native Symbian applications (J2ME MIDP applications are not eligible) and provided in a .sis install file. Entries must be developed either for the Series 60 v3 (or later) platform, or for the UIQ3 platform, and must be able to run on at least one commercially available device based on either of these platforms. Entries must be the original work of the entering individual/organisation.

6. Entries must be made by e-mailing the application install (.sis) file to developerchallenge@bt.com along with a completed entry description form. Entries must be submitted on or before the 16th of January 2008.

7. Applications will be judged by a panel comprising of one judge from BT, one judge from Symbian and one judge from an independent organization. The application will be tested on a device supporting the platform specified in the entrant’s entry description form, but the organisers cannot guarantee that this device will be the preferred device of the entrant. The winners will be selected based on how their application and accompanying entry description scores against the criteria below:

8. Winners will be notified by email on or before the 10th February 2008.

9. A list of prize winners will be published on the competition website on 16th February 2008. Winners will be announced publicly at the Mobile World Congress in Barcelona on 15th February 2008.

10. The winner may be required to participate in publicity events after the draw and by entering the promotion acknowledge their consent to take part in publicity and for their name and details of their application to be published.

11. The Judges' decision is final and no correspondence will be entered into. Entries that do not comply in full with these rules may be disqualified.

12. No cash alternative will be offered for third prize.

13. The Promoter reserves the right to alter, amend or foreclose this Competition without prior notice in the event that unforeseen circumstances make this unavoidable.

14. The Promoter accepts no responsibility for any loss, damage, injury or disappointment suffered by any entrant resulting from entering this competition or by the entrant’s acceptance of the prize, or any damage to any entrant’s or other person’s computer or mobile phone equipment as a consequence of downloading any material relating to this promotion. Nothing shall exclude the Promoter’s liability for death or personal injury resulting from its negligence.

15. By entering this competition and in consideration of their Entry being considered for the Grand Prize and other prizes or awards the Entrants each confirm and warrant that their Entry is their original work and that it is not copied in whole or in part from or infringes any other copyright work. The Entrants and each of them grant BT, Symbian, the judges and the employers of the judges all licences under intellectual property rights as shall be necessary for the competition and the judging of entries and any publicity for the competition and the winning Entries.

16. The Entries will be judged by employees of BT or Symbian or by judges from other organizations specially invited for the purpose. Neither BT nor Symbian nor any of the judges or their organisations or employers will have any obligation to treat any Entry or any part of it as confidential. Each Entrant waives confidentiality in their Entry and accepts that the Promoter cannot provide confidentiality for any Entry submitted to be judged. The Entrant shall not attach or attempt to attach any terms and conditions to its Entry and accepts that any Entry submitted with any such conditions attached may be rejected without consideration.

17. By entering this competition each Entrant accepts and acknowledges that BT and Symbian and the employers of the judges or their agents and subcontractors are involved in design or development of applications for Wi-Fi enabled devices and may be in the course of development of application or devices with similar features or technology to the Entry. The Entrant agrees that neither the submission nor judging of the Entries nor anything in these terms and conditions shall restrict BT, Symbian, the judges or such employers in any way in their development or exploitation of such application or devices.

18. Neither BT nor Symbian nor any of the judges nor any organization employing any of the judges shall have any liability however arising from the competition process or the judging process or any publicity actives including without limitation any liability for breach of confidence or other intellectual property right infringement.
