This paper comprises BT's formal response (dated August 2, 2004) to Ofcom's consultation document published on July 19, 2004.
BT welcomes the opportunity to comment on Ofcom's "Draft Determination to resolve a dispute between Energis and BT regarding the provision of Short Haul Data Services (SHDS) and Dense Wave Division Multiplexed services (DWDM)”, issued on the 19th July 2004
Ofcom are already aware of BT's view of the AISBO market definition and their subsequent assessment of BT's market power from our response to the Leased Lines Markets Review (LLMR), and for reasons of brevity we have not repeated our arguments in this response. However, as a result of the LLMR process, Ofcom now consider BT to have SMP in the AISBO market, and our response to this dispute takes account of this view.
To conclude, BT agrees to launch the LES PPC equivalent products as specified in paragraph 1 of Ofcom's Draft Determination within the time-scales proposed. Please also refer to BT's response to Question 2 below.
