1. BT welcomes the opportunity to comment on Ofcom's draft resolution of a dispute between Energis and BT relating to BT's charges for WLR ISDN2 between 28 November 2003 and 1 October 2004 issued on 2nd February 2005.
2. BT agrees with Ofcom that the calculations supporting its rental price of £71.88 per line per quarter included some errors and also accepts some of the cost adjustments proposed by Ofcom during its own investigation into the price. BT however disagrees with Ofcom's calculation of the overcharge and submits its own.
3. BT agrees with Ofcom that as a result of the errors and adjustments mentioned in paragraph 2 above, Energis should receive a refund. BT however disagrees with the proposed period over which the refund should apply and proposes a reduced period to take into account the impact of other SMP conditions.
